Hoje falaremos sobre a remo\u00e7\u00e3o de empregada p\u00fablica por motivo de sa\u00fade, com base na jurisprud\u00eancia do Tribunal Superior do Trabalho (TST).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Inicialmente, comentaremos sobre o instituto da remo\u00e7\u00e3o de servidor p\u00fablico estatut\u00e1rio por motivo de sa\u00fade, conforme a Lei 8.112\/1990. Na sequ\u00eancia, falaremos brevemente sobre o direito \u00e0 sa\u00fade.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ap\u00f3s, veremos o que o TST entende acerca da aplica\u00e7\u00e3o da remo\u00e7\u00e3o prevista na Lei 8.112\/1990 para empregada p\u00fablica por motivo de sa\u00fade.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vamos entender isso!\u00a0<\/p>\n\n\n<div id=\"remocao-de-empregada-publica-por-motivo-de-saude\">Remo\u00e7\u00e3o de empregada p\u00fablica por motivo de sa\u00fade<\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading has-luminous-vivid-orange-color has-text-color has-link-color wp-elements-264cd4d4f9518ffa550338c38fc2c7f4\" id=\"h-remocao-na-lei-8-112-1990\"><span id=\"remocao-na-lei-8-112-1990\">Remo\u00e7\u00e3o na Lei 8.112\/1990<\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A Lei 8.112\/1990, em seu artigo 36, afirma que a remo\u00e7\u00e3o \u00e9 o <strong>deslocamento do servidor<\/strong>, a pedido ou de of\u00edcio, no \u00e2mbito do mesmo quadro, com ou sem mudan\u00e7a de sede.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Portanto, a remo\u00e7\u00e3o difere-se da redistribui\u00e7\u00e3o (artigo 37 da mesma Lei), que consiste no <strong>deslocamento do cargo p\u00fablico<\/strong>, ocupado ou vago, para outro \u00f3rg\u00e3o ou entidade do mesmo Poder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A remo\u00e7\u00e3o, como se percebe, foca no servidor e pode ocorrer tanto por vontade da Administra\u00e7\u00e3o P\u00fablica (de of\u00edcio) quanto a pedido do servidor, se dividindo em tr\u00eas categorias.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1)<\/strong> <strong>Remo\u00e7\u00e3o de of\u00edcio:<\/strong> ocorre no interesse da administra\u00e7\u00e3o \u00e9 tem fundamento na supremacia do interesse p\u00fablico sobre o privado. Nesses casos, salvo exce\u00e7\u00f5es, o servidor deve acatar a decis\u00e3o administrativa e ser removido.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2) Remo\u00e7\u00e3o a pedido<\/strong>: a remo\u00e7\u00e3o simplesmente a pedido do servidor, sem nenhum motivo jur\u00eddico, ocorre no interesse (a crit\u00e9rio) da Administra\u00e7\u00e3o. Se n\u00e3o for do interesse administrativo que o servidor permane\u00e7a e n\u00e3o houver preju\u00edzo, poder\u00e1 haver a remo\u00e7\u00e3o a pedido.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3) Remo\u00e7\u00e3o a pedido, independentemente do interesse da Administra\u00e7\u00e3o<\/strong>: nesses casos a remo\u00e7\u00e3o ocorrer\u00e1 porque o servidor pediu, mas a Administra\u00e7\u00e3o n\u00e3o ter\u00e1 escolha sen\u00e3o acatar o pedido do servidor. Esta categoria se divide em outras 03 subcategorias:<\/p>\n\n\n\n<div class=\"wp-block-group is-style-cnvs-block-bg-light\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"wp-block-paragraph\">a) para acompanhar c\u00f4njuge ou companheiro, tamb\u00e9m servidor p\u00fablico civil ou militar, de qualquer dos Poderes da Uni\u00e3o, dos Estados, do Distrito Federal e dos Munic\u00edpios, que foi deslocado no interesse da Administra\u00e7\u00e3o;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b)<strong> por motivo de sa\u00fade do servidor, c\u00f4njuge, companheiro ou dependente <\/strong>que viva \u00e0s suas expensas e conste do seu assentamento funcional, condicionada \u00e0 comprova\u00e7\u00e3o por junta m\u00e9dica oficial;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">c) em virtude de processo seletivo promovido, na hip\u00f3tese em que o n\u00famero de interessados for superior ao n\u00famero de vagas, de acordo com normas preestabelecidas pelo \u00f3rg\u00e3o ou entidade em que aqueles estejam lotados.\u00a0<\/p>\n<\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">A subcategoria que importa para n\u00f3s hoje \u00e9 a constante da al\u00ednea \u201cb\u201d do inciso III do artigo 36 da Lei 8.112\/1990. Leia-a com aten\u00e7\u00e3o!<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Por fim, \u00e9 importante destacar que a Lei 8.112\/1990 disciplina a remo\u00e7\u00e3o de servidor p\u00fablico estatut\u00e1rio por motivo de sa\u00fade, <strong>n\u00e3o se aplicando, via de regra, aos empregados p\u00fablicos, que s\u00e3o regidos pelas normas da Consolida\u00e7\u00e3o das Leis do Trabalho (CLT).<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading has-luminous-vivid-orange-color has-text-color has-link-color wp-elements-1e1e5114563c0047eb928d5c33614992\" id=\"h-direito-a-saude-na-constituicao-federal\"><span id=\"direito-a-saude-na-constituicao-federal\">Direito \u00e0 sa\u00fade na Constitui\u00e7\u00e3o Federal<\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">O artigo 196 da Constitui\u00e7\u00e3o Federal afirma que <strong>a sa\u00fade \u00e9 direito de todos e dever do Estado,<\/strong> garantido mediante pol\u00edticas sociais e econ\u00f4micas que visem \u00e0 redu\u00e7\u00e3o do risco de doen\u00e7a e de outros agravos e ao acesso universal e igualit\u00e1rio \u00e0s a\u00e7\u00f5es e servi\u00e7os para sua promo\u00e7\u00e3o, prote\u00e7\u00e3o e recupera\u00e7\u00e3o.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trata-se de um <strong>direito social <\/strong>(artigo 6\u00ba da CF) que se relaciona, ainda, com o direito \u00e0 <strong>vida<\/strong> e \u00e0 <strong>dignidade da pessoa humana<\/strong>, uma vez que aquele \u00e9 essencial para a garantia destes dois \u00faltimos direitos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O direito \u00e0 sa\u00fade \u00e9 t\u00e3o relevante que inclusive o artigo 167, inciso IV, que veda a <strong>vincula\u00e7\u00e3o de receita de impostos<\/strong>, faz uma<strong> exce\u00e7\u00e3o <\/strong>quando essa receita for destinada a recursos para as a\u00e7\u00f5es e servi\u00e7os p\u00fablicos de <strong>sa\u00fade<\/strong>, al\u00e9m de outras hip\u00f3teses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a\u00e7\u00f5es e servi\u00e7os p\u00fablicos de sa\u00fade<strong> autorizam, ainda, a interven\u00e7\u00e3o<\/strong> dos Estados nos Munic\u00edpios, bem como da Uni\u00e3o nos Estados-membros, quando n\u00e3o houver a <strong>aplica\u00e7\u00e3o do m\u00ednimo do or\u00e7amento exigido<\/strong> a esse t\u00edtulo, vide artigos 34, inciso VII, al\u00ednea \u201ce\u201d; e 35, inciso III, ambos da CF\/88.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-luminous-vivid-orange-color has-text-color has-link-color wp-elements-d831a527d5e2db08d55f249a8aa77da5\" id=\"h-entendimento-do-tst-no-rr-n\u00ba-625-39-2023-5-20-0004\"><span id=\"entendimento-do-tst-no-rr-no-625-39-2023-5-20-0004\">Entendimento do TST no RR n\u00ba 625-39.2023.5.20.0004<\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">No julgamento do <a href=\"https:\/\/consultaprocessual.tst.jus.br\/consultaProcessual\/consultaTstNumUnica.do?consulta=Consultar&conscsjt=&numeroTst=625&digitoTst=39&anoTst=2023&orgaoTst=5&tribunalTst=20&varaTst=0004&submit=Consultar\" target=\"_blank\" >Recurso de Revista (RR) n\u00ba 625-39.2023.5.20.0004<\/a>, a 8\u00aa Turma do TST entendeu que o artigo 196 da Constitui\u00e7\u00e3o Federal concedeu especial prote\u00e7\u00e3o ao direito \u00e0 sa\u00fade,consect\u00e1rio l\u00f3gico do direito \u00e0 vida.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Isso porque imp\u00f4s o dever a todos de ado\u00e7\u00e3o de medidas que reduzam os riscos de doen\u00e7a e seu agravamento, <strong>em qualquer que seja a dimens\u00e3o institucional em que atue, inclusive na qualidade de empregador.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Al\u00e9m disso, destacou-se que, tratando-se de doen\u00e7a grave, tal circunst\u00e2ncia excepcional deve ser pautada na razoabilidade e na necessidade de prote\u00e7\u00e3o dos direitos fundamentais \u00e0 dignidade da pessoa humana, \u00e0 vida e \u00e0 sa\u00fade da trabalhadora, nos termos dos arts. 1\u00ba, III, 5\u00ba, \u2018caput\u2019, e 6\u00ba da Constitui\u00e7\u00e3o Federal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Desse modo, no caso concreto em exame, o TST entendeu que <strong>o direito \u00e0 sa\u00fade deveria prevalecer frente \u00e0s normas internas<\/strong> da reclamada (Empresa Brasileira de Servi\u00e7os Hospitalares).<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXeFau3CMUJmvQ6jxH-Ctm7ujc0Rt70MkfuZ7U7-yh-c8ImxCw6vuEoV3uYIW6GBAxWl6ktt2Y4YZfi2lr6F1zDuPpF9e2nicZMKMc0ips4PyZ-Qv2WGeVPu4ykFSInoyzX48hfjIw?key=7Lx7i-rf8RWsoS2U9ROW4TjR\" alt=\"\"\/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">Ademais, consignou-se que nesse caso <strong>n\u00e3o haveria sobreposi\u00e7\u00e3o do interesse particular sobre o interesse p\u00fablico<\/strong>, visto que a empregada p\u00fablica <strong>continuar\u00e1 a prestar servi\u00e7os \u00e0 empresa, por\u00e9m em outra localidade do pa\u00eds<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Desse modo, conclui-se ser de interesse da Administra\u00e7\u00e3o P\u00fablica ter resguardada a sa\u00fade da reclamante, uma vez que, em contrassenso, mant\u00ea-la nesta situa\u00e7\u00e3o poderia lev\u00e1-la a se aposentar por invalidez \u2013 o que acabaria acarretando a perda do servi\u00e7o dela em qualquer localidade.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Por fim, o TST entendeu que, <strong>ainda que o contrato de trabalho da reclamante seja regido pela CLT,<\/strong> o que a princ\u00edpio afastaria a aplica\u00e7\u00e3o do artigo 36, III, da Lei 8.112\/90,<strong> referida norma pode ser aplicada por analogia extensiva e como fonte de interpreta\u00e7\u00e3o.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O fato de a reclamante (empregada p\u00fablica) ser idosa nesse caso apenas refor\u00e7ou a ado\u00e7\u00e3o do entendimento do TST, com base inclusive no Estatuto do Idoso (Lei n\u00ba 10.741\/2003).<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-luminous-vivid-orange-color has-text-color has-link-color wp-elements-279a5e8b98253c828060b0d39029f252\" id=\"h-conclusao\"><span id=\"conclusao\">Conclus\u00e3o<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Portanto, pessoal, este foi o nosso artigo sobre a remo\u00e7\u00e3o de empregada p\u00fablica por motivo de sa\u00fade, com base na jurisprud\u00eancia do Tribunal Superior do Trabalho (TST).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Como vimos, o Tribunal Superior do Trabalho possui entendimento no sentido de que \u00e9 poss\u00edvel a aplica\u00e7\u00e3o anal\u00f3gica do artigo 36, III, da Lei 8.112\/1990, ou ainda dos artigos constitucionais acima citados, para assegurar a transfer\u00eancia de empregada em virtude do seu estado de sa\u00fade.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00e3o deixe de revisar o assunto em seu material de estudo e praticar com diversas
